Evidence in license plate reader case OK by courts

In a Norcross Georgia case involving the use of a license plate reader the state Supreme Court ruled that evidence in the case that led to a marijuana arrest can be admitted in court.

reader“In a contested decision released Monday morning, the Georgia Supreme Court upheld a Gwinnett judge’s decision that evidence of marijuana cannot be suppressed in a case about a traffic stop.

In a majority opinion, a five to two decision, written by Justice Keith Blackwell, the Court of Appeals should have never given a decision, but instead transferred the case to the state Supreme Court.

The Court of Appeals was evenly split, with six judges voting to uphold the trial court’s decision, and six judges dissenting. And under the state constitution, in that case, jurisdiction is automatically transferred to the state’s highest court, according to the Supreme Court.”
